DealOrbit — Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using DealOrbit ("the Service"), you agree to these Terms of Service ("Terms"), which form a binding agreement between you and Deal Orbit LLC. If you do not agree, do not use the Service.

DealOrbit is intended for use by individuals located in the United States.

2. What DealOrbit Does

DealOrbit automates parts of your real estate deal acquisition process using AI-driven workflows, CRM integrations, and data processing. DealOrbit does not guarantee any specific results, deals, or outcomes.

3. No Legal, Financial, or Real Estate Advice

DealOrbit is not a real estate brokerage, law firm, financial advisor, tax advisor, or appraisal service.

No feature, AI output, or automation should be interpreted as legal, financial, or investment advice.

4. Eligibility

You may use DealOrbit at any age, provided you can enter a binding agreement or have a guardian accept on your behalf.

5. Accounts & Access

Users must create an account through the sign-in page. You agree to:

• maintain accurate registration info
• keep your credentials secure
• accept responsibility for all account activity

We may suspend or terminate accounts for:

• illegal activity
• API abuse
• attempts to bypass security

We do not ban users for spam or misuse unless it involves illegal activity or system abuse.

6. Subscriptions, Billing & Payments

Plans

• Starter — $149/mo or $1,500/yr
• Team — $399/mo or $4,000/yr
• Enterprise — Custom

Setup Fees

• Starter: $500
• Team: $1,000

Conversation Overages

• Starter: $0.15 per conversation over 250/week
• Team: $0.13 per conversation over 1,000/week

Overages continue until the billing cycle ends.

Refund Policy

Subscriptions are non-refundable after the first 30 days.

Deal Orbit LLC may deny refunds if reasonable service has been delivered.

Cancellation

Users may cancel anytime.

Access remains active through the end of the billing period.

7. AI Messaging & Automations

DealOrbit uses AI to generate and send outbound messages (including SMS) without manual user approval.

You acknowledge that:

• The AI may generate incorrect or undesirable content
• You are fully responsible for all messages sent
• You authorize DealOrbit to send messages on your behalf
• You must monitor your workflows and automations

DealOrbit provides no guarantees regarding message accuracy or compliance.

8. TCPA, FCC, CTIA & Legal Compliance

You, not DealOrbit, are solely responsible for:

• obtaining proper consent before sending messages
• complying with the TCPA and all federal/state laws
• honoring Do Not Call lists
• ensuring recipients opted in
• managing STOP/unsubscribe requests

Indemnification

You agree to indemnify and hold harmless Deal Orbit LLC from any claims, penalties, or damages arising from your messaging activity or data usage.

9. Third-Party Integrations

DealOrbit integrates with:
GoHighLevel, Supabase, Vercel, Cloudflare, OpenAI, Zillow, Firecrawl, Dash0, and other external services.

We are not responsible for:

• outages of third-party providers
• errors caused by third-party APIs
• changes to third-party functionality

10. Data We Collect

DealOrbit may store:

• account/profile information
• contacts and lead data
• property information
• photos and attachments
• conversation logs
• CRM tags and metadata
• user preferences and onboarding details
• AI training data generated by your usage

Data is stored indefinitely unless deletion is requested.

Prohibited Data

Do not upload sensitive personal information:

• SSNs
• government IDs
• financial statements
• tax returns
• medical data

11. Intellectual Property

Deal Orbit LLC owns all rights to:

• the DealOrbit software, UI, and workflows
• automations, prompts, and model configurations
• documentation, branding, and training data structures

You may not:

• reverse engineer the platform
• reproduce or copy the software
• resell or white-label the service
• build a competing product using DealOrbit's IP

12. Service Reliability

We strive for reliability but do not guarantee:

• uninterrupted uptime
• error-free performance
• perfect AI accuracy
• compatibility with all devices
• availability during maintenance

13. Support

Support is available via:

• Email
• Phone
• Facebook/Discord DM

Response times are best-effort and not guaranteed.

14. Arbitration & Dispute Resolution

All disputes must be resolved by binding arbitration, not court.

Class actions are waived.

Governing law is Utah.

15. Limitation of Liability

DealOrbit is not liable for:

• indirect, incidental, or consequential damages
• loss of data, profits, or opportunities
• AI inaccuracies or miscommunications

Total liability is capped at the amount paid in the past 12 months.

16. Changes to Terms

We may update these Terms at any time.

Continued use of DealOrbit constitutes acceptance of the updated terms.
